§ 10-22. Purpose.

  • The intent of the board of county commissioners in adopting this chapter is to establish reasonable and uniform regulations that will reduce the negative secondary effects adult entertainment businesses have upon the county, and to protect the health, safety, morals and general welfare of the people of the county. It is not the intent of the board of county commissioners to legislate with respect to matters of obscenity because such matters are regulated by federal and state law, including F.S. ch. 847. The provisions of this article have neither the purpose nor effect of imposing an unreasonable limitation or unreasonable restriction on the content of any lawful communicative materials including sexually oriented materials. Similarly, it is not the intent nor effect of this chapter to unreasonably restrict or deny access by adults to sexually oriented materials protected by the First Amendment or to deny access by the distributors and exhibitors of sexually oriented entertainment protected by the First Amendment to their intended market. Neither is it the intent nor effect of this article to condone or legitimize the distribution of obscene or otherwise illegal material.
