§ 18-140. Location and installation.

  • All systems shall be located and installed so that with proper maintenance the systems function in a sanitary manner, do not create sanitary nuisances or health hazards and do not endanger the safety of any domestic water supply. Sewage waste and effluents from individual on-site sewage disposal systems shall not be discharged onto the ground surface or into ditches, drainage structures, surface waters or aquifers. To prevent such discharge:

    (1)

    Systems shall not be located laterally within 75 feet of any private domestic water supply well. Systems shall not be located laterally within 200 feet, or as otherwise permitted by the state department of health and rehabilitative services of any public water supply well. Locations shall be downhill or at a lower elevation than water supply wells when practical.

    (2)

    The septic tank drainfield system shall not be located laterally within 15 feet of the invert of the drainage ditch, roadside ditch or curb of a curb and gutter system, but in no even within ten feet of the inside edge of the drainage ditch and roadside swale. However, lots one-half acre or larger in size shall have a minimum separation of 25 feet from the invert of the drainage ditch and roadside swale or back of the curb or a curb and gutter system.

    (3)

    Systems shall not be located under buildings or within five feet thereof, or within five feet of property lines, provided the side slope shall not exceed 3:1 slope where property lines abut utility easements or where recorded easements are specifically provided for the installation of systems for service to more than one lot or property owner. Drainfields or other soil absorption facilities shall not be located within ten feet of potable water distribution supply lines unless such lines are encased in at least six inches of concrete or placed within a sleeve of similar material pipe to a distance of ten feet from the nearest portion of the drainfield.

    (4)

    New septic systems on newly developed and existing lots, where applicable, platted and/or recorded shall not be located within 100 feet of the ordinary high water mark of lakes, streams, canals, tidal bays and rivers or within 100 feet of the mean high water line of tidal bodies of water, including bays and tidal portions of rivers, streams and canals.

    (5)

    Any new lots located within 500 feet of the ordinary high water mark of any lakes, streams, canals, bays and rivers will require a minimum of one-half acre suitable land per system.

    (6)

    Any new lots located within 500 feet of the ordinary high water mark of any lakes, streams, canals, bays and rivers, will require a minimum 100-foot lot width where contiguous to the water body.

    (7)

    Suitable, unobstructed land shall be available for the installation of drainfields or other soil absorption facilities.
