§ 40-75. Use of the proceeds of the surtax.

(a)

The proceeds of the surtax shall be used by the county, in strict accordance with state law, for the type of items described on the project list. The county's share of the proceeds shall be accounted for in a separate special revenue fund and shall not be commingled with general fund revenue. The municipalities receiving proceeds shall use such proceeds in accordance with F.S. § 212.055.

(b)

The county and said municipalities may pledge such proceeds for the purpose of servicing new bond indebtedness incurred pursuant to law. The county and municipalities may join together for the issuance of bonds.

(c)

The surtax imposed by this division shall be collected by the state department of revenue, and distributed monthly to the board of county commissioners and said municipalities, and shall be subject to an annual audit.
