§ 40-98. Five cent tax (ELMS tax).

  • (a)

    Pursuant to F.S. § 336.025(1)(b), there is hereby imposed a $0.05 fuel tax upon every gallon of motor fuel sold in Putnam County and taxed under the provisions of F.S. ch. 206. This tax is commonly known as the ELMS tax.

    (b)

    The tax hereby imposed shall be levied as of January 1, 2010.

    (c)

    The proceeds of the tax collected herein shall be distributed to Putnam County and the incorporated municipalities located therein pursuant to separate Interlocal Agreements dated April 23, 1985, as amended, between the county and the City of Palatka, the City of Pomona Park, the City of Crescent City, the Town of Interlachen, and the Town of Welaka, respectively.

    (d)

    The funds generated by this tax shall be used for transportation expenditures needed to meet the requirements of the capital improvements elements of an adopted comprehensive plan, for expenditures needed to meet immediate local transportation problems and for any other uses allowed by law.

    (e)

    Putnam County may use the proceeds of the tax imposed herein for the purpose of collateral or pledge.
