§ 6-34. Nuisance animals.

  • (a)

    No person shall allow an animal under his or her control to become a nuisance as defined in this ordinance.

    (b)

    An owner with an animal that is a habitual nuisance shall be sent to the special magistrate for a hearing.

    (c)

    The animal control officer or law enforcement officer may cite the owner or any person having custody of such animal(s) for violation of this section when either the citing animal control officer or law enforcement officer has witnessed the commission of such habitual nuisance or the animal control officer or law enforcement officer has received at least one sworn affidavit from each of at least two unrelated adult witnesses from different residences so that taken together, the affidavits attest to the committing of a nuisance pursuant to this section.
